REGULATIONS FOR THE TRANSFER OF CASH DONATIONS FOR THE POLISH RED CROSS
I Introductory provisions
These regulations, hereinafter referred to as the Regulations, define the principles of provision bythe Polish Red Cross based in Warsaw at ul. Mokotowska 14, 00-561 Warsaw, operating on the basis of the Act of November 16, 1964 on the Polish Red Cross (Journal of Laws No. 41, item 276, as amended) and the Statute of the PCK approved by the regulation of the Council of Ministers of September 20, 2011 (Journal of Laws No. 217, item 1284), entered into the register of associations, other social and professional organizations, foundations, and independent public health care institutions of the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, XII Commercial Division of the National Court Register under number KRS 0000225587 as a public benefit organization, NIP: 526-025-04-81, REGON: 007023731, hereinafter referred to asPCK the service provided electronically, consisting of enabling individuals using the website pck.pl to transfer cash donations for the statutory activities of the PCK.
The current version of the Regulations is available on the website pck.pl.
For the purposes of these Regulations, the following terms shall be understood as follows:
Website – internet service available at the address: https://pck.pl;
Donor – a natural person, legal entity, or organizational unit without legal personality using the pck.pl website to make a donation;
Payment operator – a company mediating in the execution of payments, i.e.: PayU S.A. based in Poznań, ul. Grunwaldzka 186, 60-166 Poznań, NIP 7792308495, REGON 300523444, KRS 0000274399 or PayPal based in Luxembourg, 22-24 Boulavard Royal, L-2449 Luxembourg, company registration number: R.C.S. Luxembourg B 118 349, VAT number: LU22046007 or Polski Standard Płatności Sp. z o.o. based in Warsaw, ul. Czerniakowska 87a, 00-718 Warsaw, NIP 521-366-44-94, REGON 147055889, KRS 0000493783 or Stripe Payments Europe, Limited (SPEL) 1 Grand Canal Street Lower Grand Canal Dock, Dublin D02 H210, Ireland, registration number: 3206488LH, VAT number: IE3206488LH.
4. By making a donation, the Donor declares and confirms that they have read the content of the Regulations and accept its provisions.
II Principles of donation transfer
Donations can be made via electronic transfer, payment card (debit or credit) or mobile payment system BLIK (through PayU or directly via phone number 794 33 22 11), as well as traditional transfer or deposit made at the postal operator's office of any amount to the bank account number provided on the Website.
The transfer of donations takes place directly from the Donor's bank account, through an intermediary managing payments to the bank account or money transfers, or through the payment operator selected by the Donor, using a secure SSL certificate.
The Donor may make one-time donations or monthly donations, as described in point IV of the Regulations, allowing regular, i.e. monthly, transfer of the declared amount of money to the PCK.
Donations may be made for the implementation of projects selected by the Donor or for projects carried out as part of the statutory tasks of the PCK. In the case of traditional transfers or deposits to the bank account, the Donor bears the costs of this operation, while in the case of donations made through the Website, the payment operator transfers to the PCK the donation reduced by the commission from the transferred donation.
Details regarding online payment processing are specified in the regulations of the payment operator selected by the Donor.
From the donated amount, the PCK allocates up to 15% of the donation amount for fundraising, communication, and administration.
III Tax exemptions
The PCK is a public benefit organization. According to applicable regulations, the Donor may deduct donated amounts up to the amount indicated in the relevant laws governing the taxation of natural and legal persons.
The transfer confirmation must be kept in accordance with applicable regulations.
IV Regular donations in the form of monthly payments
By choosing to make a donation in the form of monthly payments, the Donor consents to the monthly collection by the payment operator from the payment card or from the PayPal account of the amount corresponding to the value chosen or entered by them for the donation.
The monthly donation will be collected by the payment operator (PayU) from the payment card on the day the declaration of support for the PCK is submitted, and then once a month – on the 1st or 15th day of the month.
In the event of an unsuccessful attempt to collect the donation, it will be retried only once in that month, and if the second attempt also proves unsuccessful, the donation will not be collected. Collection of the donation at the declared amount takes place the following month.
In the event of insufficient funds in the account or too low an authorization limit, the declared amount will not be collected.
On the day the Donor's card expires, charging the card will cease and donations will not be collected. The Donor can make subsequent donations after renewing the card and re-establishing regular payments on the Website using the new card.
The Donor may cancel the monthly payment at any time by submitting the appropriate request to the Payment Operator – PayPal or in the case of the second Payment Operator – PayU – by filling out the cancellation form available on the Website.
The PCK does not collect and does not process the payment card data (credit and debit) of the Donors in its IT system. These data are only provided by the Donor to the payment operator.
Details regarding the implementation of monthly payments are specified in the regulations of the payment operator selected by the Donor.
V Additional information
By making a donation, the Donor consents to the processing of personal data for the purposes of donation handling. The administrator of the personal data provided for the purpose of realizing the donation is the PCK. Details regarding the processing of personal data by the PCK are specified in thePrivacy Policy.
The PCK recommends that the Donor familiarize themselves with the regulations of the selected payment operator.
