How to transfer?
Making a will
To bequeath part or all of the inheritance to a non-profit organization (NPO), a will must be prepared in which the chosen organization is clearly indicated as the beneficiary of the inheritance. The will must meet formal requirements, e.g., it must be written by hand or in the form of a notarized document (a document drawn up by a notary). In the will, you need to specify what portion of the estate you wish to bequeath.
Selection of the type of record
In the will, donations can be made in various forms, depending on what one wishes to leave to the organization. The options include:
- General bequest: The entire estate is bequeathed to the public benefit organization.
- Specific bequest: A specified part of the estate or specific assets (e.g., real estate, financial assets, securities) are transferred to the public benefit organization.
- Percentage allocation: The donor can allocate a specified percentage of the estate or individual assets.
Exemption from inheritance tax
In Poland, public benefit organizations are exempt from inheritance and donation tax, which means that the entire amount transferred will go to the Polish Red Cross, without deductions for the Treasury. This makes transferring an inheritance in this form very effective.
The legal basis for the exemption of public benefit organizations (OPP) from inheritance and donation tax in Poland is Article 4a of the Act on Inheritance and Donation Tax of July 28, 1983 (consolidated text: Journal of Laws of 2021, item 1043, as amended).
Establishing the purpose of the donation
According to the regulations, we are obliged to use the provided funds for statutory activities, but the specific purpose can be specified in the will.
Cooperation with a notary
It is possible to create a will independently, but using the services of a notary ensures that the document will be prepared correctly and will safeguard the interests of both you and the Polish Red Cross. A notary can also advise on the best way to plan the transfer of the inheritance in the context of inheritance law.
The will transferring a donation to a public benefit organization can be changed or revoked at any time. It is advisable to regularly update the will to ensure that the wishes expressed in it are still current and in accordance with your intentions.
